Privacy Policy

Sweetpea Works LLC, provider of Pinnacle Trax Effective date: September 18, 2026

1. Who We Are

Sweetpea Works LLC is a Louisiana limited liability company with its principal place of business at 5728 Planuche St, Ste B, New Orleans, Louisiana 70123. It is the company responsible for the personal information described in this policy, and it trades under its own name.

Pinnacle Trax is a marketing system offered by Sweetpea Works LLC, and pntx.pinnacletrax.com is the website where that system is described and sold. Sweetpea Works LLC is the company you contract with, are billed by, and can contact about your information.

This policy covers pinnacletrax.com and its subdomains, the consultations and communications that follow from it, and the services we deliver to our clients. Payments appear on card and bank statements as SWEETPEAWORKSLLC.

In this policy, "we," "us," and "our" mean Sweetpea Works LLC. "You" means the person whose information we hold.

Contact us about your information: email info at sweetpeaworks.com, or write to us at 5728 Planuche St, Ste B, New Orleans, Louisiana 70123.

2. The Two Roles We Play

Role one — we are responsible for our own visitors and clients. When you visit pntx.pinnacletrax.com, request a consultation, subscribe to our communications, or become our client, we decide what to collect and why. Sections 3, 4, 7, 8, 9, and 10 describe how we handle that information.

Role two — we handle information on behalf of our clients. Pinnacle Trax builds and operates marketing systems for its clients. Those systems collect information from their prospects and customers — the person who fills out a contact form on a builder's website, requests a school tour, or subscribes to a chiropractor's newsletter.

For that information, our client decides what is collected and why, and we act on their instructions. In the language of US privacy law, our client is the business or controller and we are their service provider or processor.

If you submitted information to a business whose website we operate, this policy is not the policy that governs you. That business's own privacy policy does. We handle your information only to deliver the service they engaged us for. We do not use it for our own purposes, we do not sell it, and we do not market to you on our own behalf. If you want your information corrected or deleted, contact that business directly — they are the ones who can instruct us. If you contact us instead, we will pass the request to them promptly and support them in honoring it.

Section 6 sets out our commitments in this role.

3. What We Collect About You

Information you give us

  • When you request a consultation or contact us: your name, business name, email address, phone number, profession, location or market, and whatever you choose to tell us about your business and your marketing.
  • When you subscribe to our communications: your name and email address.
  • When you become a client: business and billing details, the information supplied through the onboarding questionnaire, credentials and access we need to deliver the service, and your ongoing communications with us.
  • When you pay us: billing name, billing address, and the payment details you enter — credit or debit card details, or bank account and routing details for ACH payments.

We do not store or process payment details ourselves. One-time invoices are issued and paid through QuickBooks. Recurring subscription payments are processed by Stripe on automatic payment. When you pay, your card or bank details go directly to those providers and are handled under their security standards and privacy policies, not ours. We receive confirmation that a payment succeeded or failed, the amount, the date, and a masked reference — never the full card number and never your full bank account number.

Information collected automatically

When you visit pntx.pinnacletrax.com we collect standard technical information: IP address, browser type and version, device type, operating system, referring page, pages viewed, time on page, and approximate location derived from IP address. We collect this through cookies and similar technologies — see Section 5.

Information from other sources

We may receive information from publicly available business sources, your public website and social profiles, and from referrals. Where a case study or testimonial names your business, we obtain your approval before publishing.

What we do not collect

We do not seek, and ask that you do not send us, sensitive personal information — Social Security numbers, financial account credentials, health information, or government identification numbers. Several of the professions we serve handle sensitive information in their own work. Where our systems will touch anything of that nature, it is addressed in the engagement documentation, not by general submission.

4. Why We Use It

We use personal information to:

  • Respond to your inquiry and hold a consultation
  • Provide, operate, maintain, and improve our services
  • Bill you and administer your subscription
  • Communicate with you about your account, deliverables, approvals, and service changes
  • Send marketing communications you have asked to receive, or that relate to services you already receive from us
  • Understand how our website is used, so we can make it better
  • Protect our systems, prevent fraud and abuse, and enforce our Terms
  • Meet legal, tax, and recordkeeping obligations

We do not sell your personal information, and we do not share it for cross-context behavioral advertising. We do not use advertising or retargeting cookies on our website, and we do not pass identifiers about you to advertising platforms.

Marketing emails. Every marketing email we send includes an unsubscribe link and our physical address, as the CAN-SPAM Act requires. Unsubscribing stops marketing email; it does not stop service and billing messages to an active client, which are part of the service.

We communicate by email, not text. Email creates a clear, retrievable record of what was said and when, which matters in a service built on approvals and deliverables. We do not send marketing text messages. In the rare case we send a text at all, it is transactional — a time-sensitive message about active work — and only where you have given prior express consent, as the Telephone Consumer Protection Act requires. You can stop them by replying STOP or telling us.

We never market using our clients' contacts. Information collected through systems we operate for our clients is handled under Section 6 and is never used for our own marketing.

5. Cookies and Analytics

Our website uses cookies and similar technologies to make the site work, remember your preferences, and understand how visitors use it.

Essential cookies are required for the site to function, including security, page delivery, and performance. They cannot be turned off.

Analytics cookies tell us how many people visit, which pages they read, and where they arrived from, so we can improve the site. We use this to understand traffic patterns, not to build advertising profiles or follow you across other websites.

Your choices. You can refuse or delete cookies through your browser settings, and most browsers let you block them by category. Blocking essential cookies may break parts of the site; blocking analytics cookies will not.

Do Not Track. Browsers send Do Not Track signals inconsistently and there is no agreed standard for responding, so we do not respond to them.

6. Information We Handle for Our Clients

Where we operate a marketing system for a client, we handle personal information collected through that system on the client's behalf and on their instructions. In that role we commit to the following:

  • We use it only to deliver the service our client engaged us for.
  • We do not sell it. We do not share it. We do not use it for our own marketing. Our client's contacts are our client's contacts, not a list we have access to.
  • We do not combine it with information from other clients or from our own operations.
  • We keep it secure as described in Section 7.
  • We support the client's obligations. If a person exercises a privacy right with our client, we help the client honor it.
  • The client keeps their contacts and data. Clients may request a copy of their contact records at any time during the subscription and on cancellation. We return or delete the records at the client's direction when the engagement ends.
  • We use subprocessors — the infrastructure and platform providers that make the service work. We require them to protect the information and use it only to provide their service to us. We identify them to a client on request.

If your information is in a client's system, contact that client. They control it. We will support their response.

7. How We Protect It

We use administrative, technical, and physical safeguards appropriate to the sensitivity of the information — including encrypted transmission, access controls limiting access to people who need it, managed security and monitoring on the systems we operate, and regular updates and maintenance.

No system is perfectly secure, and we cannot guarantee absolute security. If a breach affects your personal information, we will notify you and any required authority as the law requires.

8. How Long We Keep It

We keep personal information for as long as we need it for the purpose we collected it, and then for as long as we are required to keep it.

  • Inquiry and consultation information: 24 months after our last contact with you, unless you become a client or ask us to delete it sooner.
  • Client records: for the life of the relationship and afterward as required for tax, accounting, and legal purposes — generally seven years.
  • Marketing subscribers: until you unsubscribe, plus a suppression record so we do not email you again.
  • Website analytics: in aggregate, indefinitely; individual-level records for no longer than 26 months.

9. Children

Our services are for businesses. Our website is not directed to children, and we do not knowingly collect personal information from anyone under 18. If you believe a child has given us personal information, contact us and we will delete it.

A note specific to the schools we serve. Pinnacle Trax builds marketing systems for Montessori schools and independent early-childhood schools. Those systems are designed to collect information from parents and prospective parents — adults inquiring about enrollment or requesting a tour. They are not designed to collect information from or about children, and they are not student information systems, enrollment platforms, or education records systems.

Where a school engages us and children's information is unavoidably involved — a photograph of a child in marketing imagery, for example — the school is responsible for obtaining any parental consent that applies.

10. Your Rights

Depending on where you live, you may have rights to know what personal information we hold about you and how we use it, to access a copy, to correct inaccuracies, to delete it, to opt out of sale or sharing for targeted advertising, to limit use of sensitive information, and to not be discriminated against for exercising these rights.

Everyone gets the same treatment. We extend the core rights above to anyone who asks, regardless of state, because administering different standards by residence is a good way to get it wrong.

How to exercise your rights. Email us at info at sweetpeaworks.com, or write to us at the address in Section 1. We will verify your identity before acting, and respond within the time the law allows — generally 45 days, extendable where the law permits.

Authorized agents. You may use an authorized agent where the law allows. We will ask for proof of authorization.

Appeals. If we decline your request, you may appeal by replying to our response.

If your information is in a client's system, contact that client — see Sections 2 and 6.

11. Other Sites

Our website links to other websites, including our clients' sites. We do not control them and this policy does not cover them. Read the policy of any site you visit.

12. Where Your Information Is Held

We operate in the United States and hold personal information here. If you access our services from outside the United States, your information will be transferred to and processed in the United States, where privacy laws differ from those in your country.

13. Changes to This Policy

We may update this policy. The current version always lives on our website with its effective date at the top. Material changes affecting how we use information we already hold will be communicated to affected clients and subscribers by email at least 30 days before they take effect.
